A 24 year old woman was volunteering at a food drive and directing traffic in the parking area. The defendant, driving a rental car, was directed by the volunteer to apply his brakes. While fully intending to do so, the defendant accidentally applied the accelerator instead. The rental vehicle backed into the plaintiff and pinned her against a concrete wall.
As a result of this incident, the plaintiff suffered multiple fractures and tears of varying severity in her lower extremities. She needed two surgeries and physical therapy to recover. Her medical bills totaled around $60,000.00.
Luckily, the plaintiff has improved dramatically from the incident, but still has difficulties going from sitting to standing, running, and wearing certain shoes.
The case was eventually settled for $375,000.00.
