If you are arrested, convicted or plead guilty to OUI/DUI charges in Massachusetts, the Registry of Motor Vehicles (RMV) will suspend your driver’s license. The suspension periods are mandated by state law and depend on the number of priors. The suspensions are 1 year for a first offense, 2 years for a second, 8 years for a third, 10 years for a fourth, and a lifetime for a fifth offense.
For a second or subsequent OUI/DUI conviction or drug program assignment, an Ignition Interlock Device must be installed and remain in any vehicle you drive for 2 years after your license is reinstated. If your license has been suspended, you are entitled to a hearing in front of a Registry Hearing Officer to seek reinstatement, or a hardship license.
The Registry Hearing Officer has some discretion in determining whether or not to grant a hardship license or reinstatement. For hardship applications, the hearing officer has a checklist to follow. The first item on the list is no evidence of operation of a motor vehicle since the license was suspended.
Other items include proof of hardship, compliance with probation, completion of a proper alcohol treatment program, and that the minimum license revocation time for hardship consideration has been served.
